To properly complete a legal
adoption in Ecuador, a Dossier must have the following documentations:
Certified and authenticated copies of the
adoptive parent(s)’ birth certificate(s).
Certified and authenticated copy of the
adoptive parent(s)’ marriage certificate, if applicable) and proof of
termination of any previous marriage (certified copy of spouse’s death
certificate or divorce decree).
Medical certificate(s) for adoptive parent(s)
executed by physician before a notary public and authenticated.
Criminal record from a local police
department notarized and authenticated.
Verification of employment and salary (from
employers) notarized and authenticated.
A home study prepared by an authorized and
licensed adoption agency certified.
Psychological report executed by a
psychologist before a notary public and authenticated.
Adoption authorization from the agency to
the family certifying that the family has been duly prepared for adopting
an Ecuadorian child, notarized and authenticated.
Six photographs of the petitioners and of
their family environment (home).
Post-adoption follow up commitment executed
by the family before a notary public and authenticated.
NOTE: Documents have to be
authenticated at the nearest Ecuadorian Consulate.
The attorney will escort the
family to all meetings and appointments (related to the adoption proceedings),
such as the child’s physical exam with the American Embassy Doctor, passport
application, hearings before the Minors Tribunal, getting new Ecuadorian
documents for the child, etc. His fee includes meeting the family at Quito
Airport upon arrival, assisting them with hotel reservations, and being at the
airport with them upon departure, if it is from Quito. Obtaining the Visa at the
American Consulate in Quito and Guayaquil is not part of the adoption process
itself, and because there are two new I.N.S. offices in Quito and Guayaquil,
delays have been increased sometimes up to one more week.
The
following is an explanation of his fees, per adoption. They total 12,000 US
Dollars per case including most expenses (translations, Ecuadorian
notarizations, child’s documents such as passport, visa application, etc.):
The
initial non-refundable payments of $4,000 is due at the time the agency
sends the adoptive family’s dossier to Ecuador. It covers the
legalization of foreign documents in Ecuador, filing the petition at the
Adoptions Office, and getting the approval of the petitioners.
The second non-refundable payment of $4,000
is due at the time the agency receives a letter of proposal (referral of a
child), issued by the Adoptions Office. It covers the abandonment
proceedings.
The
last payment of $4,000 is due once the attorney gets the Adoption Decree
(usually within two weeks of arrival), and the agency receives a written
authorization by fax from Ecuador signed by the adoptive parents saying
that the Ecuadorian part of the adoption has been completed. Otherwise, it
can be paid directly by the parents in Ecuador.
